Referral terms & conditions
By submitting a referral through this programme, you (“Referrer”) agree to the following Terms & Conditions.
Eligibility
The Referral Programme is open to individuals aged 18 years and above.
The Referrer must not perform, or hold themselves out as performing, estate agency work on our behalf. A Referrer is not our employee, representative, agent or real estate salesperson by virtue of participating in this programme.
The Referrer must not negotiate, advise on, market or otherwise participate in any property transaction on our behalf.
What constitutes a valid referral
A referral will be considered a “Valid Referral” only where:
(a) the referred person is the owner, or an authorised representative of the owner, of a residential property in Singapore;
(b) the referred person is genuinely considering selling the property;
(c) the referred person was not already known to us as a prospective seller, in active communication with us regarding the sale of the property, or previously referred to us before the Referrer's submission;
(d) the information submitted by the Referrer is genuine and accurate to the best of the Referrer's knowledge;
(e) the referral is submitted through our designated referral form or another method expressly accepted by us; and
(f) the referral otherwise complies with these Terms & Conditions.
We reserve the right to determine whether a referral constitutes a Valid Referral, acting reasonably and based on our records.
Permission to make the referral
By submitting another person's personal information, the Referrer confirms that the referred person has agreed to have their details shared with us for the purpose of discussing the possible sale of their property.
Referrers must not submit personal information obtained without the referred person's knowledge or permission.
We may contact the referred person to verify the referral and their willingness to speak with us.
Referral reward
A referral reward of S$888 will be payable for each Valid Referral that results in a Successful Sale.
For the purposes of this programme, a “Successful Sale” occurs only when:
(a) the referred seller formally appoints the relevant licensed estate agency to market and/or facilitate the sale of the property;
(b) a legally binding sale of the referred property is subsequently entered into through our estate agency services;
(c) the transaction is successfully completed; and
(d) the estate agency has received the commission payable in respect of that transaction.
The referral reward is fixed at S$888 regardless of the eventual selling price of the property, subject to these Terms & Conditions.
No referral reward is payable merely because a referral was submitted, the referred person contacted us, appointed us, received an offer, granted an Option to Purchase, or entered into a transaction that subsequently fails to complete.
Payment
Where a referral qualifies for payment, the S$888 referral reward will be paid within 30 days after the estate agency has received its commission from the completed transaction.
Payment will be made using a payment method determined or agreed by us.
The Referrer is responsible for providing accurate payment details.
Duplicate referrals
Where the same person or property is referred by more than one person, only the first Valid Referral received by us will qualify for the referral reward.
Our timestamped records will determine which qualifying referral was received first.
No referral reward will be divided between multiple Referrers unless we expressly agree otherwise in writing.
Existing contacts and clients
No referral reward will be payable where, before receiving the referral, the referred person:
(a) was already our client;
(b) had already contacted us regarding selling the relevant property;
(c) was already being actively engaged by us regarding the sale of the relevant property; or
(d) had previously been introduced or referred to us by another person.
Self-referrals
Unless expressly stated otherwise, a property owner referring themselves does not qualify for the S$888 referral reward.
No obligation on the referred person
Submission of a referral does not create any obligation for the referred person to appoint us or our estate agency.
Any appointment to perform estate agency work will be separately agreed between the property owner and the relevant licensed estate agency in accordance with applicable laws and regulations.
Prohibited conduct
Referrers must not:
(a) make false, misleading or unauthorised representations about us, our estate agency or our services;
(b) represent themselves as acting on our behalf;
(c) negotiate commissions, selling prices or other terms of a property transaction;
(d) advertise or market a referred property on our behalf;
(e) provide estate agency advice or services on our behalf;
(f) submit fabricated, fraudulent or unauthorised referrals; or
(g) engage in conduct that breaches any applicable law or regulation.
A referral arising from prohibited conduct may be disqualified.
Personal data
Personal data submitted through the Referral Programme will be collected, used and disclosed for purposes reasonably connected with administering the referral, contacting the referred person, providing estate agency services where requested, administering payments, preventing fraud and complying with applicable legal or regulatory requirements.
By submitting a referral, the Referrer consents to the collection, use and disclosure of their own personal data for these purposes.
Personal data relating to referred persons will be handled in accordance with applicable data protection laws and our Privacy Policy.
Fraud and abuse
We reserve the right to reject or disqualify referrals where we reasonably believe there has been fraud, manipulation, duplication, misrepresentation, abuse of the programme or a breach of these Terms & Conditions.
We may request reasonable information necessary to verify a referral before making payment.
Changes or termination
We may amend, suspend or terminate the Referral Programme at any time.
However, any Valid Referral submitted before the effective date of such amendment, suspension or termination will continue to be assessed under the terms applicable when the referral was submitted, unless continuation would breach applicable law or regulation.
Limitation
Participation in this Referral Programme does not guarantee that a referred property will be listed or sold.
We make no representation or guarantee regarding the time required to sell any property, the selling price achievable, or whether the referred person will appoint us.
Governing law
These Terms & Conditions are governed by the laws of the Republic of Singapore.
Any dispute arising out of or in connection with the Referral Programme or these Terms & Conditions will be subject to the jurisdiction of the courts of Singapore.
